Terms of Use

Welcome to TTMS Food websites, mobile experiences, and related online properties (collectively, the "Site"). Through the Site you may access software and software-as-a-service features ("Software"); pages, data, text, images, audio, video, and documents ("Materials"); and interactive areas such as forums, comments, uploads, or messaging where you may submit or share content ("Community Services"). Software, Materials, Community Services, and other information or services made available through the Site are referred to together as "Content."

These Terms of Use ("Terms") are a legal agreement between you ("you" or "your") and TTMS Food and its affiliates ("TTMS," "we," "us," or "our") governing your access to and use of the Site and Content. By accessing or using the Site or Content, you agree to these Terms and to our Privacy Policy. We may update the Terms or Privacy Policy at any time; the updated versions are effective when posted on the Site. You should review this page periodically.

1. Terms applicable to specific content and areas

Certain areas of the Site or specific Content may be subject to additional rules, guidelines, license terms, or agreements (for example, enterprise agreements, restaurant onboarding terms, or product-specific licenses). If there is a conflict between these Terms and those additional terms for a specific area or Content, the additional terms control for that area or Content only.

2. Use of software

Your use of Software is governed by any license agreement, order form, subscription terms, or click-through terms presented with that Software. If Software is made available without separate License Terms, you may use it only: (a) for your own internal or personal, informational purposes in connection with TTMS Food services; (b) without modification except as expressly permitted; and (c) without redistribution except as features of the Site expressly allow (for example, approved embeds or API use under a written agreement).

3. Use of materials

Unless Materials are expressly offered under different terms, you may view, download, store, display, and print Materials we publish or make available for download solely: (a) for your personal or internal business informational purposes; (b) without modification of proprietary notices; and (c) without redistribution except as the Site expressly permits (such as sharing a public link).

4. Use of community services

Community Services are provided for convenience. We are not obligated to provide technical support for every community feature, and community content may include opinions from users or third parties that are not official TTMS Food support or policy. You agree to use Community Services only: (a) for lawful, informational, or business-related purposes consistent with these Terms; (b) without redistributing Content in a way that violates these Terms; and (c) without harvesting personal data about other users except where the Site expressly permits and applicable law allows.

5. Reservation of rights

The Site and Content are protected by intellectual property laws. Except for rights expressly granted to you, TTMS Food and its licensors reserve all rights, title, and interest. Content is provided on an "as is" and "as available" basis. We may suspend or revoke permissions granted in Sections 2–4 at any time, including if you breach these Terms.

6. Your content

You may only upload, post, or share Content that you have the right to share and for which you can grant the licenses below. By sharing Content on or through the Site, you grant TTMS Food a worldwide, non-exclusive, royalty-bearing or royalty-free license (as stated in any separate agreement, or otherwise as needed to operate, improve, secure, and promote the Site and our services) to host, reproduce, modify, adapt, display, perform, distribute, and create derivative works in connection with the Site and TTMS Food offerings, including incorporation into products or documentation where applicable and permitted by law.

You represent that you have the rights to grant the foregoing, that our use will not knowingly infringe third-party rights, and that applicable moral rights have been waived or cannot be asserted to prevent such use, to the maximum extent permitted by law. You will not use the Site or share Content that: is false or misleading; defamatory or harassing; invades privacy or includes others' confidential information without authority; promotes discrimination or harm; is obscene or unlawful; infringes intellectual property or other rights; violates export or sanctions laws; contains malware; or constitutes unauthorized solicitation or spam.

Unless we have entered a separate written confidentiality agreement with you, do not send us information you consider highly confidential through open forms on the Site. Content you share in unrestricted areas may be treated as non-confidential for purposes other than personal data handled under our Privacy Policy.

7. Security, passwords, and access

You must not use the Site in any way that could damage, disable, overburden, or impair our systems or other users' access, or attempt unauthorized access to accounts, data, or networks. Automated access (scraping, bots) is prohibited without our prior written consent, except for public search engines as we allow by robots policy. If you create an account, you must provide accurate registration information, safeguard passwords and credentials, and notify us promptly of unauthorized use.

8. No unlawful or prohibited use

You will not use the Site or Content for any unlawful purpose or in any manner prohibited by these Terms or by any area-specific rules posted on the Site.

9. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless TTMS Food and its officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of Content you share, your violation of these Terms or applicable policies, or your violation of third-party rights.

10. Monitoring and moderation

We have no obligation to monitor the Site but may review use and Content, and may remove or refuse to host Content that we believe violates these Terms, applicable law, or third-party rights, or that poses security or operational risk. We may use automated tools and human review where appropriate.

11. Termination of use

We may suspend or discontinue the Site or any Content, or limit your access, at any time, with or without notice, including for suspected infringement or legal violation. You agree that TTMS Food shall not be liable to you or any third party for any such suspension or discontinuance, except where applicable law requires otherwise.

12. Third-party sites, content, and services

The Site may link to or integrate third-party websites, payment providers, maps, analytics, or other services. We are not responsible for third-party content or practices. Your use of third-party services is at your own risk and subject to their terms.

13. Health and dietary information

Information on the Site related to food, nutrition, allergens, or wellness is for general information only and is not medical advice. Restaurants and menus are responsible for accurate allergen and dietary disclosures where required. Always consult a qualified professional for medical, dietary, or emergency decisions. Do not disregard professional advice because of something you read on the Site.

14. Disclaimer

EXCEPT WHERE EXPRESSLY STATED OTHERWISE, THE SITE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, TTMS FOOD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT RESULTS WILL BE ACCURATE OR RELIABLE. YOU USE THE SITE AND ANY DOWNLOADED CONTENT AT YOUR OWN RISK. WE ARE NOT RESPONSIBLE FOR DAMAGE TO YOUR DEVICES OR LOSS OF DATA FROM USE OF THE SITE.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TTMS FOOD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

16. Exclusions and limitations

If any disclaimer or limitation in these Terms is held invalid, the remaining provisions remain in effect to the maximum extent permitted.

17. Privacy

Our collection and use of personal information is described in our Privacy Policy. Personal data may be processed in accordance with that policy, including transfers and subprocessors where permitted by law.

18. Age of majority

If you are not of legal age to form a binding contract in your jurisdiction, you may not use the Site except with supervision and consent of a parent or guardian as required by law. Do not submit personal information about minors except as the Site expressly allows.

19. Export and sanctions compliance

You may not use or export the Site or Content in violation of applicable export control or sanctions laws. You represent that you are not prohibited from receiving U.S. or other applicable-origin services and are not located in a comprehensively sanctioned jurisdiction or on applicable restricted party lists, except as authorized by law.

20. Availability of products and features

References on the Site to products, plans, or features may not be available in every region. Contact us or your account representative for availability in your location.

21. Waiver and severability

Failure to enforce a provision is not a waiver. If any provision is unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the rest of these Terms remain in effect.

22. Governing law and disputes

Unless your separate written agreement with TTMS Food specifies otherwise, these Terms are governed by the laws of the State of California, without regard to conflict-of-law principles that would require application of another jurisdiction's laws. Subject to mandatory provisions of local law, the Superior Court of California, County of San Bernardino, shall have exclusive jurisdiction over disputes arising from these Terms or the Site that are brought in state court. If you are a consumer, you may have non-waivable rights in your country of residence.

23. Intellectual property

TTMS Food names, logos, and product names are trademarks of TTMS Food or its licensors. Other marks on the Site may belong to their respective owners. You may not remove or alter proprietary notices, or use TTMS Food marks without prior written permission, except as fair use or nominative use permits.
